1.0 Privacy

Your privacy is important to us. For more information on how we use any data collected from you along with information on how your information is used please see our Privacy Policy.

2.0 The Information You Share

Any information you share on Carmooch will be visible to the greater community. While we encourage our users to share as much information as possible we respect your right to keep it private. If you want to keep your updates to yourself (and later on, your network) then visit your account settings and make the necessary changes.

If you share feedback comments and/or suggestions with Carmooch they may or may not be implemented. In the case they are, Carmooch is not liable to reimburse any party who has provided such to the entity.

3.0 Housekeeping

3.1 You will not post unauthorised commercial communications

3.2 You will not upload malicious code or viruses to Carmooch

3.3 You will not solicit log in information to accounts you do not own

3.4 You will not bully, intimidate or harass any other user

3.5 You will not post any content that is hateful, demeaning, threatening or pornographic to Carmooch including nudity and gratuitous violence

3.6 You will not use Carmooch to post anything unlawful, discriminatory, offensive, misleading or malicious

3.7 You will not do anything that may disrupt the running of Carmooch including butnot limited to denial of service attacks and overburdening the servers.

3.8 You will not encourage any violations of this statement

3.9 You will not use Carmooch in a manner for which it was not intended

3.10 You will ensure opinions shared on Carmooch are unbiased, educated andjustified

3.11 You acknowledge that any reliance on any opinion, advice, statement, orinformation available on Carmooch is at your sole risk, and we may not be held responsible for any loss or misfortune.

4.0 Account Integrity

4.1 You will only provide relevant and truthful information about yourself when registering and using the Carmooch platform. If you are registering on behalf of someone you must have their explicit permission to do so.

4.2 You will not create more than one personal profile for the purpose of exploiting Carmooch’s intended limitations

4.3 If Carmooch disables your account, you will not create another one without permission

4.4 You will not share your password with anyone or do anything that could jeopardise the security of your account.

4.5 Carmooch reserves the right to reclaim any username or account that is deemed to not be related to the user (e.g. is a trademarked name)

4.6 You will not falsely represent yourself to gain access to an account type for which you are not eligible

5.0 Looking After You

5.1 You will not post content or engage in any activity that violates someone’s rights or the law

5.2 Carmooch reserves the right to remove any content that is deemed to be inappropriate or irrelevant

6.0 Mobile Usage

The Carmooch mobile app is on its way. Once released it will be available free of charge for everyone. It is important to remember that your carrier might charge you to use some of our services (because our app requires an internet connection). You should seek to confirm these charges with your carrier first before using the app as Carmooch cannot be held liable for any costs incurred.

7.0 Connecting With Our Partners

If you choose to be contacted or get in contact with our partners, you agree to the Privacy Policy and agree that Carmooch is not liable for any communications that take place outside of the Carmooch domain and platform.

8.0 Limits of Liability

While Carmooch strives to maintain a 100% uptime record, this may not always be achievable. Carmooch is not liable for any financial losses resulting from downtime of the website. No party may seek compensation as a result of website downtime.

We take the utmost care in implementing review data, however mistakes can happen. We take no responsibility for any losses or damage caused by the inaccuracy of our data. If you have found an error, please contact the webmaster to have this corrected webmaster@carmooch.com

Carmooch shall not be liable to any party in respect to any claim, demand or action, regardless of the nature of the cause of the claim or action alleging any loss, injury or damages, direct or indirect, which may result from the content of this site.

9.0 Third Party Content

In part, Carmooch is a review aggregation service and as such we source content from various third party outlets that are not owned or controlled by us. This content is always credited to the original source and not intentionally misrepresented in any way. We provide only a brief snapshot and encourage users to visit the original page to read the full content.

Carmooch provides links to full reviews only as a convenience, and the inclusion of any link does not imply our affiliation, endorsement, or adoption of the linked site or any information therein.

10.0 Carmooch Intellectual Property

Carmooch contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, feels, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms.

Specific model ratings are the property of Carmooch and are derived by assigning an overall rating based on our interpretation of the critic’s opinion of a vehicle in a review and in conjunction with a critics own score where available. As a result, the rating displayed on Carmooch may not exactly match the critic’s original rating from the source content. If you feel we have grossly misinterpreted a review with our rating feel free to contact us.

11.0 Who & What We Don’t Like

Carmooch will immediately block and remove any accounts that are (1) deemed to be set up by a competitor to Carmooch or (2) if you are caught “screen-scraping” or attempting to download content off the Carmooch website without explicit permission from the owners. If your account is blocked and/or removed then you are not permitted to create another account without first obtaining the permission of the Carmooch team.

12.0 Indemnification

You indemnify us and hold us harmless for all damages, losses and costs (including, but not limited to, reasonable attorneys’ fees and costs) related to all third party claims, charges, and investigations, caused by (1) your failure to comply with this Agreement, including, without limitation, your submission of content that violates third party rights or applicable laws, (2) any content you submit to the Services, and (3) any activity in which you engage on or through Carmooch.

13.0 Content

Whilst we at Carmooch have made every attempt to make sure the data you see is relevant and up to date, by accepting this agreement when you sign up you are agreeing that you will not hold Carmooch responsible for any errors that may arise. This includes, but is not limited to, vehicle range, pricing and availability. Carmooch is purely an information based tool and take no responsibility for purchasing decisions you make based on the information provided. Carmooch does not recommend any particular brands and maintains and unbias standpoint. Any purchasing decisions made by a user of Carmooch are done so at the user’s discretion and you agree to not hold Carmooch liable at any point.
